Peter DiCola calls in to talk GIRL TALK [10am]

Law professor Peter DiCola, co-author of the forthcoming book Creative License: Digital Sampling, Culture, and the Law, calls in to talk Girl Talk.

Earlier this week, the Illegal-Art label dropped All Day, the first release in over two years by the world's most renowned mashup artist. The free, purportedly "Creative Commons" release is a pop culture kaleidoscope with 372 overlapping samples of songs by the likes of The Rolling Stones, Prince, Nirvana and Beyoncé. Girl Talk claims this is a transformative fair use, and we'd like to believe him, but then again, it was released on a label called "Illegal Art". So why hasn't Girl Talk been sued? We'll address this question and more with Peter DiCola, an expert on copyright law’s regime for digital sampling.

live music from Detroit's scifi sloppunk heroes HUMAN EYE [11am]

With Human Eye, Timmy "Vulgar" Lampinen space-launches the Iggy Pop spirit he brought to his earlier garage-punk bands (Clone Defects & Epileptix) stepping into new dimensions that reflect reality through science fiction. Human Eye's debut full-length was released by In The Red in 2005 and their latest, Fragments of the Universe Nurse, came out on Hook or Crook.

Meanwhile Timmy's Organism -- originally conceived as a solo 4track recording project -- has taken off with a nice set of 7-inches and the brand new Rise of the Green Gorilla LP (Sacred Bones).

WARNING: certain visual aspects of Human Eye's live set (like the octopus and the silver tubing) may not translate over the radio, so you gotta see 'em live!!!

LINEUP: Alien pianos-Johnny Lzr Drums/percussion/sax-Hurricane William Guitar/vocals-Timmy Lampinen Bass-Brad Hales

Girl Talk's Cheap.......And Jason Sigal Signaled In The Thursday Mid Morning
  10:06am
Cecile:

This is fun, but I still like Radio Soulwax's Skee-lo mashup there.
  10:09am
Vicki (People Like Us - also on Illegal Art!):

morning
  10:10am
Cecile:

He hasn't been sued because he knows what he's doing and has the stones to back it up.
  10:10am
Cecile:

morning!
  10:10am
Vicki (People Like Us - also on Illegal Art!):

Fatboy Slim paid Negativland's record company to sample something by Negativland that they didn't even own in the first place :)
  10:11am
fishmonkeystew:

Howdy All!
  10:13am
Vicki (People Like Us - also on Illegal Art!):

there's a whole mafia of people that would run to Girl Talk's side to help him
  10:18am
Cecile:

unpredicatable = bonkers
  10:19am
Cecile:

Who I think is really transformative is Basement Jaxx. Girl Talk is kind of instigating, and God bless him for it, but he's not really writing new songs off them.
  10:19am
john:

Girl Talk is like, an interesting Pop Culture experience... and I appreciate that he pushes the legal limits. But musically it doesn't really add up to much more than those mashups you see cheerleaders dance to at bad halftime shows
  10:23am
Vicki (People Like Us - also on Illegal Art!):

also someone doing the clearance would not get replies from a lot of people if the person is considered small fish
  10:26am
Todd 76%:

I've been involved in making u'ground music since the early '80s and one of the biggest kicks I've ever gotten was when Eye from the Boredoms sampled/looped one of my band's songs for a Hanatarash track. For us, it was an honor!
  10:32am
Cecile:

Kraftwerk are very protective because they feel an artist is completely responsible for what their music conveys and inspires. It's impressive but not good if you are a sampler.

I think a whole big part of this problem is that most members of US Congress wouldn't know art if it were painted across their face.
  10:35am
Cecile:

Todd, that's awesome. What track was it?
  10:38am
dc pat:

yeah, really. If Eye samples you, you're doing something right.
  10:43am
dc pat:

Nice talk Jason, as usual. Always something to think about on your show. Thanks.
  10:45am
dc pat:

YEAH, Amanda!!
  10:49am
dc pat:

YEAH, Sediment Club!!

...where'd everybody go?
  10:51am
jason:

hey thanks DC Pat!

Vicki that's awesome re: Negativland -- do you know if Fatboy Slim was licensing the Negativland arrangement, and then separately licensing the music Negativland sampled?
  10:56am
jason:

HUMAN EYE coming up in ~10 minutes!!
  11:00am
postmanpaul:

Hi Jason, this is nice. Am here via a wfmu portal. Scary. Just met SmokinJ and Charlie in another dimension.
Maybe a litlle morrocan pollen was involved, I don't know...
  11:01am
Tom:

Oh man, lovin this Hayvanlar, was blastin it last night makin BROWNIES!
  11:03am
jason:

hey PMP! what portal was that?? how are smokinj and charlie?
  11:04am
dc pat:

What?! You mean there's some OTHER place to hang out?
  11:09am
postmanpaul:

Charlie benevolently redirected me (cheshire-cat like...) back here and SmokinJ said something dream-like, like, 'that's just like paul, going getting lost in these parts..."
Yes there is another place, dcpat... another way.
  11:10am
mark in cbus:

does amanda have a fan club? i want an amanda t-shirt.
  11:11am
dc pat:

Ya gotta listen to the Amanda interviews. Hilarious, she still talks like that.
  11:15am
postmanpaul:

I personally can't 'get into' the prevailing Amanda hysteria... and god knows I've tried!
  11:19am
Tom:

rockin!

Jason, do ya know if Human Eye has something comin out?
  11:21am
jason:

yes they have a 7'' coming out on Scion's record label (a split with Sex Beat) and an LP coming out on Sacred Bones!
  11:23am
SmokinJ:

Wow! That was fun!
  11:23am
tim:

Does anyone else who lives outside of Michigan use the term "party store"? People didn't know what the hell I was talking about when I moved to Illinois and said I was going to the party store.
  11:24am
SmokinJ:

Here in Brewtown it's 'Beer Depot' tim...
  11:24am
dc pat:

I don't know what the hell yer talking about unless you're going to go get some balloons and paper plates.
  11:25am
gauche:

I'm stoked on this Amanda "hysteria". I've been waiting for a "where is she now" follow up since the first time i heard her played on fmu a couple of years ago.
  11:28am
Tom:

Man, where does Timmy find time to sleep?
  11:29am
tim:

Yeah, that's what I'm talking about, DC Pat. People were amazed that I found a "party store" that also sold beer and booze.
  11:31am
dc pat:

yeah, well now THAT's a real party store. We don't have those around here...
  11:32am
Todd 76%:

@ Cecile: Sorry had to step away for a bit. It's track 7 on Hanatarash 4 if I remember correctly. It samples the whole intro to 76% Uncertain's "Condo" from our third LP, with Eye's panned hard left or right, alternating... screeching . Thanks, dc pat!
  11:34am
Cecile:

Detroit is a pit, but Detroit people are the greatest. Rock on, Timmy and crew!
  11:36am
Cecile:

Timmy Lampinen, I bet you have family in the UP.
  11:38am
Cecile:

Also, Human Eye reminds me of Todd (Tamanend) Clark a little - Rust Belt sci fi psych
  11:47am
dc pat:

man, Druid Perfume is cool.
  11:56am
efd:

Conspiracy Of Owls - ALBUM OF THE YEAR!! (maybe)
  11:57am
efd:

Top 10 for sure... I still need to get my list together.
  11:58am
Nate in Detroit:

Great live set and interview! And thanks for the mini Detroit set...I live in the same neighborhood as a couple of those bands
  12:20pm
hank:

Conspiracy of Qwls = a Parliament...
