@Stevel: Yes, good question. When most people publicly arrange 3 circles a certain way, it summons Disney lawyers! I think South Park gets away with their portrayals because satire is considered protected speech. I think the Legal precedent has to do with Larry Flint's portrayal of Jerry Falwell.

@Alex: Not quite. Falwell's case against Flint was defamation. Because he's a public figure, and because Flint's work was satire, Falwell lost. The lead fair use case relying on parody is the 2 Live Crew case brought by the company that licensed Roy Orbison's "Pretty Woman."

Re Disney, that Sparks song just didn't rise to the level of a TM infrnigement by even the more Disney-favorable intepretation. There was no visual representation, for one thing, where source confusion is more present. It's not parody, so the Flynt case isn't really applicable. Perhaps if Justin Timberlake came out with a song called "Mickey Mouse" there'd be more source confusion b/c of his past association; and Sparks were probably just way off a Disney lawyer's radar. Copyright isn't applicable at all.

@Alex: Gotcha. I don't know the SP episodes. I'm puzzled by courts' literary critical aptitudes. An important 9th Cir. case involved an account of the O.J. Simpson murder trial dressed up as The Cat in the Hat. Seuss sued and prevailed, presumably because TCitH wasn't the object of the infringing publication's ridicule. I would disagree, but I'm not the 9th Cir.

I think that Cat in the Hat case came out wrong; it hinged on the difference between parody (exception) and satire (no exception), because the book merely used Seuss's work/style/copyrightable elements as a vehcile; it didn't comment on Cat in the Hat. The book was easy to visually confuse with a Seuss book, but only an idiot wouldn't discover otherwise by the time they paid at the counter.

So Weird Al borrows Blurred Lines, but his Word Crimes has NOTHING to do with the lyrics or meaning or controversies related to the original's own status as filched stuff, so it's not parody, just....borrowed for its familiarity. No one would likely care enough or be foolish enough to sue, but still interesting in terms of what one artist can do with another's material.

I have a question about a site where one can purchase sheet music for a song, but the sheet music does not credit the songwriter at all, but calls it "Irish Traditional" and also claims the wrong music publishing company. Can the songwriter, the correct publishing company, and the one falsely credited all sue?

I'm an IP lawyer Alex. There haven't been lawsuits over sheet music in a long while, so far as I'm aware, but your hypothetical, assuming its accuracy, sounds like infringement. That said, I imagine showing damages would be difficult in such a case. But if your friend could easily demonsrate authorship of the work, a letter might suffice.

@tikk: I do not know the songwriter personally. I actually bought sheet music for Fiddler's Green, then noticed that instead of being credited to John Connolly, it said "Irish Traditional". I mentioned it on the Mudcat site, to make sure I was correct about the author, and someone there also looked up the publishing company printed at the top of the sheet music, and found that the song is not in their catalog. I think the author is British or Irish, and not a US citizen.

In books, CE and proofers don't always get mentioned—sometimes the CE gets a nod in the author's acknowledgments, and sometimes, far more rarely, the proofer and CE are credited on the copyright page—but in magazines (tho' less so in scholarly journals) it's more common to see CEs and proofers thanked. It could be those staffers or freelancers, in the case of that magazine, were snowed under working for multiple titles for that publisher, but you never know. If it's a family operation, the top brass may not be objective enough to see their kin aren't living up to their job descriptions.
