Tonight: Big Tech and insurrection - discussing with station manager Ken Freedman

Links:

Twitter's Trump Ban Deemed Necessary, Derided as Long Overdue (by Sarah Frier in Bloomberg News, Jan. 9, 2021). Quoting former Facebook employee Yael Eisenstat: "Inciting your followers to engage in insurrection is a high form of treason and allowing your platform to be used for that purpose makes you complicit."

The bright side of insurrection (by Mark Hurst on creativegood.com, Jan. 7, 2021)

The algorithmic amplifier fueling corruption in Silicon Valley (by Mark Hurst, May 29, 2020): "Twitter depends on Trump to supply the garbage that fuels the business model. The ethical decision here for Twitter is obvious: if someone is posting violent, libelous, and otherwise illegal material, shut down the account. Twitter knows how to do it, they have done it in some past cases, and Twitter's own terms-of-service claims that it will do it. But they can't, here: the president's toxic spew is too valuable to the business. The corruption at the heart of Silicon Valley, the algorithmic amplifier, relies on Trump. It's a match made in hell."

Donald Trump being banned from social media is a dangerous distraction (by Matt Stoller and Sarah Miller in the Guardian, Jan. 11, 2021): "Whatever one thinks of stopping Trump fomenting violence by limiting his ability to communicate, the ability of democratically unaccountable monopolies with extraordinary control over communications infrastructure, like Facebook and Google, YouTube's parent company, to silence political speech is exceptionally dangerous. It also sidesteps the underlying problem – that it's their dominance and business model that promotes conspiratorial, fake and violent content to millions."

Evening all! Ashli Babbitt was shot and killed by a cop, and a cop was killed with a fire extinguisher. Another rioter was trampled to death when she fell to the ground. Two other rioters, it's unclear, but the guy who supposedly "tased himself in the balls" did not in fact do that. He did die of a heart attack but it's unknown what the details of his heart aattack were.

Related: Being extremely skeptical of mainstream news reporting, I wondered why so often I was reading Trump had "incited" the riot, yet very little concrete evidence would appear in stories reporting as much. It would just go without saying, which is irresponsible reporting. Some stories characterized Trump's *failure* to call off the rioters as incitement. That's a stretch, legally speaking. But here in WaPo is a very helpful red-lined transcript of his speech, noting where Trump's statements and rhetoric might support a finding of incitement to imminent lawless action:

Handy H., totalitarianism doesn't particularly encourage hate speech. What totalitarians foment is ONE-SIDED speech -- their side. If you say you hate THEM, they don't allow that. You get as much "I hate your guts" sentiment in free societies as unfree ones, maybe more.

  6:23pm
Dean:

I'm comfortable drawing my own conclusions, for sure, but my conclusions are mere opinions, legally speaking. I worry when the reporting fails to explicitly connect dots that must be connected to support state prosecutorial action.

And watch it with "treason," as it has a specific constitutional provision: "Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court."
